I once thought about what would it be like living in those apartments by the beach, but they were right next to this night club.  I wonder do they ever think about how noisy night clubs affect their neighbours?  The idea of loud noise and drunks really turned me off as I have to get up pretty early.  In addition to that, I like to sleep in from time to time.

Well, what can you do about it?  If you live close to a night club and the noise is bothering you, there are a few things you can do about it.  As a tenant and neighbour, you have rights.  The Live Music Act 2012 took out specific regulations regarding live music that takes place in businesses that have a license.

As the person bothered by the noise, you can either –

  • Use the ‘Prevention of Public Nuisance’ clause contained in the license for the premises, if possible.
  • Register your complaint with Environmental Services online.

The site should provide an explanation of the proper steps to go about completing the form.  In the meantime, you should line your ducks in a row or plainly, get your evidence together and file a record of the nuisance.  They will use this document as a part of their investigation into your complaint.

If  your case is legitimate, the authorities will serve a Noise Abatement Notice.  This will prevent the business from future annoyances.  If the owner ignores the warning and advice, this now becomes a criminal conduct issue and is handled accordingly.

However, before you do all of this, have you talked to the club owner personally?  Maybe they don’t even realize how noisy night clubs affect their neighbours.  Solving the problem could be as simple as talking to the right people.  Talk to your neighbours and see if they are willing to sign a statement supporting your efforts.
